Responsibility for Obtaining and Maintaining Permits

According to the interpretation manual, the UoC is responsible for developing a good understanding of local licensing and permit systems applicable to their operation. This understanding must be active and current—farms cannot assume that past compliance means future compliance. Key responsibilities include:

  • Identifying all applicable licences and permits required in their jurisdiction.
  • Obtaining all necessary documentation before and during operation.
  • Monitoring pending licence renewals and tracking critical dates.
  • Understanding conditions attached to each licence or permit and ensuring compliance with those conditions.
  • Maintaining documentation in up-to-date form throughout the certification period.

Evidence Required for Audits

Farms must maintain comprehensive records to demonstrate compliance. The interpretation manual specifies that evidence should include:

  • Up-to-date documentation covering siting, construction, and operation.
  • Records of any licence or permit applications currently in progress.
  • Proof that conditions set as part of licence or permit applications are being adhered to.

Auditors will review this documentation directly and may also cross-check that the farm understands the specific conditions attached to each permit. For example, some jurisdictions issue business licences only if mandatory certificates of building fitness and emergency preparedness for natural disasters have been obtained. Farms must be able to demonstrate they have met these prerequisites and are maintaining the required standards.

Scope and Site-Specific Context

The interpretation manual acknowledges that licensing requirements vary by geography and production system. A farm's obligations depend entirely on the regulatory framework of its location and the nature of its operations. Farms operating in remote offshore locations, land-based facilities, or recirculating systems may face different permit requirements than farms in other settings.

The manual emphasises that it is the responsibility of each UoC to understand its own regulatory environment. When in doubt, farms are directed to seek assistance from governmental agencies dealing with business, environment, and community matters in their jurisdiction.

Practical Implementation

For compliance staff and audit preparation, farms should:

The interpretation manual does not require farms to hold more permits than their jurisdiction mandates, nor does it provide exemptions from legally required documentation. Rather, Indicator 1.1.1 requires transparent demonstration that whatever permits and licences are applicable have been obtained and are being maintained in current form.

Integration with Other Requirements

Legal compliance on licensing forms the foundation for all other requirements in the ASC Farm Standard. Subsequent criteria across environmental, social, and animal welfare dimensions often incorporate or reference legal compliance as a baseline. For instance, farms must ensure that labour contracts comply with applicable law (as noted under this indicator), and they must adhere to any environmental regulations set by their authorities. Licensing compliance is thus an entry point to broader certification readiness.

Auditors will treat documentation of current, applicable licences and permits as a non-negotiable component of any ASC certification audit. Farms that cannot provide complete and current licensing documentation will not progress to assessment of other indicators.
